YeIsland User Agreement
Welcome to Xiaoyedao (hereinafter referred to as "the Platform"). The Platform is committed to providing professional psychological counseling services, including but not limited to counseling appointments, online counseling, meditation guidance, psychological assessments, popular science articles on psychology, and anonymous venting functions.

Before you register as a user of the Platform and use its services, please carefully read and fully understand the terms of this User Agreement (hereinafter referred to as "the Agreement"), especially the clauses highlighted in bold or otherwise reasonably brought to your attention. By accessing and/or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Agreement, as well as any updates to these terms that may occur due to business development. If you do not agree with any part of this Agreement or do not fully understand the explanations provided, please refrain from confirming your acceptance (including, but not limited to: clicking "I agree," proceeding to use the program, etc.) or continuing to use the services under this Agreement.
1. User Registration and Information Protection

1.1 Users must confirm their full legal capacity when registering and using services on this platform ("the Platform"). If a user is under 14 years old, they must obtain parental consent for registration and use of the Platform's services under parental supervision. The Platform reserves the right to immediately deactivate accounts of users who do not meet the eligibility criteria, with all responsibilities and consequences borne by the user and their guardian.

1.2 Users are required to register a "Xiaoyedao" account before using the Platform's services. Ownership of "Xiaoyedao" accounts belongs to the Platform. Upon completing the registration process, users gain the right to use the "Xiaoyedao" account. Users are responsible for the security of their accounts and passwords, including setting or modifying passwords and account closure. No third party may use a registered account without the user's permission; any such use will be considered as the user's own action.

1.3 Users must provide true, accurate, current, and complete personal information during registration and promptly update it to ensure the effectiveness of services. The Platform assumes no responsibility for any failure or errors in service provision resulting from inaccurate or outdated information provided by users.

1.4 Real-Name Authentication: In accordance with the laws and regulations of the People's Republic of China, to protect network information security and provide better user services, the Platform may require users to complete real-name authentication. Users must complete this authentication to use related services as per usage rules. If users do not agree to undergo real-name authentication, related services will not be provided, but users can still access other basic functions of the Platform.

1.5 The Platform will not disclose users' personal information to third parties without consent, except as required by applicable laws and regulations. Users are responsible for safeguarding account numbers, passwords, and other account information. Users must promptly notify the Platform if they suspect unauthorized use of their accounts. The Platform is not liable for any losses resulting from force majeure (including hacking, computer viruses, system instability, etc.), fraud by others, or user negligence in safeguarding account information.

2. Service Content

2.1 The Platform offers services including but not limited to: counseling appointments, online counseling, meditation guidance, psychological assessments, popular science articles on psychology, and anonymous venting.

2.2 All counselors on the Platform are qualified professionals. Users can schedule counseling appointments according to their needs and receive counseling services online.

2.3 Meditation, psychological assessments, popular science articles on psychology, and anonymous venting are designed to provide users with auxiliary tools and information related to mental health. They should not be considered professional medical advice.

3. User Responsibilities

3.1 Users may not use the Platform for any illegal or improper activities, including but not limited to posting, transmitting, or disseminating illegal information, infringing on others' intellectual property or other legal rights, harming public interests, violating public order and morals, or creating false information to mislead other users. The Platform reserves the right to remove, delete, block such information, ban or deactivate accounts, and users are solely responsible for any legal liabilities incurred.

3.2 Users must safeguard their account information and passwords. Users are responsible for any losses incurred due to their own negligence in protecting their account information.

3.3 Users agree to receive commercial information from the Platform via email, SMS, messaging apps, or other means.

4. Disclaimer

4.1 The Platform serves as a communication bridge between users and counselors and assumes no legal responsibility for counseling content.

4.1.1 Users understand and agree that the effectiveness of counseling depends on the collaborative efforts of counselors and users. The Platform and counselors do not guarantee specific outcomes from counseling. Refunds are generally not provided after counseling services, and the Platform bears no legal responsibility for service outcomes or refunds.

4.1.2 During counseling, in cases of sudden illness or accidental death caused by the user, or self-injury, self-mutilation, or suicide due to the user's own reasons, the Platform and counselors will take measures to mitigate the situation and may contact emergency contacts, relevant departments, or medical institutions if necessary. Users (or guardians) bear all responsibilities and consequences arising from such incidents, and the Platform and counselors are not liable for damages.

4.1.3 Counseling services provided by the Platform are not medical diagnosis, treatment, or healthcare services as defined in the Regulations on the Administration of Medical Institutions of the State Council. Users with suicidal tendencies or attempted suicide should seek treatment from crisis intervention organizations or legally recognized medical institutions. Counselors do not provide crisis intervention, psychological therapy, diagnosis, or treatment for mental disorders. Users who choose to self-harm, self-mutilate, or attempt suicide bear full responsibility and consequences.

4.1.4 Disputes, fee disputes, or service quality disputes arising from counseling services are to be resolved through mutual agreement between counselors and users. The Platform assumes no responsibility for such disputes.

4.2 Psychological assessments are developed according to general psychological rules. Results generated by the system after user completion are for reference only. The Platform makes no guarantees and assumes no legal responsibility for assessment results, which should not be used for diagnosis, intervention, or resolution of psychological crises or disorders.

4.3 The Platform reserves the right to temporarily or permanently suspend services due to regular or irregular maintenance or operational needs. Users will receive advance notice of such suspension. The Platform is not responsible for delays, inaccuracies, errors, omissions, or interruptions caused by such maintenance or operational activities.

4.4 The Platform is not liable for interruptions in network services, timely delivery of network services, security, accuracy, or other defects caused by force majeure, third parties, or factors beyond its control. Users are advised to timely save their relevant data. The Platform is not liable for any losses due to network service interruptions, maintenance, repair, etc.

5. Amendment of Agreement

5.1 The Platform reserves the right to update this Agreement and related sub-agreements, platform product/feature usage rules, etc. (collectively, "Service Agreements"), including but not limited to periodically publishing or revising service rules, usage rules, announcements, notifications, etc. Updates will be effective on specified dates as notified through system prompts, site messages, and/or contact information provided by users on the Platform. By continuing to use the services, users agree to accept the updated Service Agreements. Users' rights, obligations, service content, etc., are subject to the latest Service Agreements. If users do not agree to the revised Service Agreements, they have the right to discontinue using the Platform or its corresponding products and services.

6. Intellectual Property Authorization

6.1 The Platform owns all rights (including but not limited to copyrights, trademarks, patents, trade secrets, and other related rights) to all products, technologies, programs, materials, and information content (including but not limited to text, images, graphics, photos, audio, videos, charts, colors, layout designs, electronic documents) within the platform.

6.2 Users agree to grant the Platform exclusive, perpetual, royalty-free authorization to use all works published on the Platform for commercial purposes. This includes but is not limited to rights such as reproduction, distribution, rental, exhibition, performance, broadcast, information network dissemination, filming, adaptation, translation, compilation, and rights that should be enjoyed by copyright holders.

6.3 The Platform has the right to use the authorized works for purposes including but not limited to publication on the platform, publication on other self-media channels, adaptation into other types of works, compilation with other works on the Platform. The ownership of adapted works belongs to the Platform.

7. Authorization for Use of Personal Information

7.1 Operational data recorded by the Platform, including but not limited to user information, user lists, user relationships, user usage data, transaction data, order data, etc., belongs entirely to the Platform. The Platform shall not collect or use such information beyond the scope necessary for providing product services.

7.2 Without written consent from the Platform, no person may use user lists, user relationships, etc., to send promotional information to users, or illegally store, back up, disclose, use, or authorize others to use the aforementioned operational data. Upon termination or dissolution of the User Agreement, the Platform will not provide or back up such data to users.

7.3 Users authorize the Platform to use their personal information as necessary within the scope of providing product services.

7.4 Upon account cancellation, the Platform shall promptly delete users' personal information. Users have the right to request deletion of their personal information during account use.

8. Default Liability

8.1 Both parties to the agreement must strictly abide by the User Agreement, related Service Agreements, rules, and must not violate the agreement or harm the legitimate rights and interests of each other or third parties using the Platform.

8.2 Upon notification of a breach by one party, the breaching party must take effective and reasonable remedial measures to correct the breach and compensate the non-breaching party for losses. If the breaching party fails to correct the breach within seven days of receiving notice, the non-breaching party has the right to unilaterally terminate this Agreement in writing and deactivate the account.

8.3 Termination of this Agreement by the non-breaching party or remedial measures by the breaching party do not prevent the non-breaching party from pursuing breach liabilities as stipulated in the contract.

8.4 Liability for Breach:

8.4.1 If the platform breaches the agreement, commits infringement, or causes damages to users, compensation is limited to the total amount paid by the user.

8.4.2 If users breach the agreement, commit infringement, or cause damages to counselors, compensation is limited to the actual losses suffered by the counselors.

8.5 Losses include, but are not limited to, compensation to third parties, loss of income, cost of investment, expenses for rights protection travel, litigation fees, notarization fees, and lawyer fees.

9. Miscellaneous

9.1 This agreement takes effect when users click to confirm and log in to use the platform.

9.2 If any provision of this agreement becomes invalid or unenforceable due to changes in laws, regulations, or policies, the invalidity of that provision does not affect the validity of other provisions, which remain in full force.

9.3 Both parties shall abide by the content of this agreement. In case of disputes during execution, they shall negotiate amicably. If negotiation fails, both parties have the right to bring the dispute to the people's court at the domicile of the platform operator for resolution under the laws of the People's Republic of China.

Please ensure you have fully read, understood, and accepted all the terms of this agreement before registering and using the platform's services. Your registration, login, and use of the platform constitute your acknowledgment and acceptance of the above agreement's constraints.
